1. Who you are contracting with

dwellwrite is operated by Calvin Jenkins Jr ("dwellwrite", "we", "us", or "our"), a sole proprietor doing business as dwellwrite. By creating an account or using the service, you ("you" or "user") agree to be bound by these Terms & Conditions.

2. Acceptance

By accessing or continuing to use dwellwrite, you agree to these terms. If you do not agree, do not use the service. If you are using dwellwrite on behalf of a brokerage or organization, you represent that you have authority to bind that organization.

3. The service

dwellwrite provides AI-generated marketing content for real estate professionals, including MLS descriptions, social captions, email copy, open house content, and buyer-side content. Outputs are generated by AI and may contain inaccuracies — you are responsible for reviewing and editing any output before publishing or sharing it.

4. Your account

You must provide accurate registration information and keep your account credentials confidential. You are responsible for all activity under your account. You must be of legal age to enter into a binding contract in your jurisdiction.

5. Acceptable use

You agree not to: (a) use the service unlawfully or fraudulently; (b) send spam or misleading communications; (c) infringe anyone's intellectual property; (d) generate content that is discriminatory, harassing, or violates Fair Housing laws; (e) interfere with the service's security (malware, probing, scraping, reverse engineering); (f) resell or redistribute the service; or (g) circumvent any usage limits or technical restrictions.

6. AI content responsibilities

dwellwrite uses generative AI models. You acknowledge that: (a) outputs may be inaccurate or incomplete; (b) you are responsible for verifying property details, compliance with MLS rules, Fair Housing laws, and brokerage policy before publishing; (c) you own the outputs you generate subject to these terms; (d) you grant us a limited license to process your inputs solely to provide the service. You must not use dwellwrite to generate deceptive listings or misrepresent property facts.

7. Intellectual property

dwellwrite retains all rights to the service, software, branding, and underlying technology. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. You retain ownership of your inputs and generated outputs.

8. Payment and subscription

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, subscription renewals, cancellations, and refunds are handled by Paddle and are subject to Paddle's Buyer Terms. See our Refund Policy for refund details.

9. Service level

We work hard to keep dwellwrite available, but we do not guarantee uninterrupted or error-free performance. Scheduled maintenance, third-party outages, or AI provider disruptions may temporarily affect availability.

10. Suspension and termination

We may suspend or terminate your access for: (a) material breach of these terms; (b) non-payment; (c) security or fraud risk; (d) repeated or serious policy violations, including misuse of the AI features. You may cancel your subscription at any time through Paddle (paddle.net) or your account page. On termination, your access ends at the close of the current billing period and your data may be deleted after a reasonable export window.

11. Disclaimers

To the fullest extent permitted by law, dwellwrite is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. dwellwrite is a marketing tool — it is not legal, financial, or real estate compliance advice.

12. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion would be unlawful.

13. Indemnity

You agree to indemnify and hold harmless dwellwrite from any third-party claims arising out of your use of the service, your content or inputs, your violation of these terms, or your violation of any law or third-party right.

14. Changes to the service or terms

We may modify the service or these terms from time to time. Material changes will be communicated by email or in-app notice. Continued use after changes take effect constitutes acceptance.

15. Governing law

These terms are governed by the laws of the United States and the state in which Calvin Jenkins Jr resides, without regard to conflict of laws principles. Disputes shall be resolved in the courts located in that jurisdiction.
